A Davenport man has been sentenced to 18 months in federal prison after being found guilty of possessing a firearm as a felon.

Court documents and evidence presented during sentencing revealed that Rodolfo Tellez Gutierrez, Jr., 23, threw a gun out of the window of a vehicle during a traffic stop. Authorities reviewed Gutierrez’s phone and found messages with the purchaser of the recovered firearm.

Following his prison term, Gutierrez will be subject to three years of supervised release. Federal law does not allow parole.

United States Attorney David C. Waterman for the Southern District of Iowa announced the sentence. The Scott County Sheriff’s Office investigated the case.

This prosecution is part of Project Safe Neighborhoods (PSN), an initiative that coordinates law enforcement agencies and communities to address violent crime and gun violence. The Department of Justice launched an updated violent crime reduction strategy for PSN on May 26, 2021, focusing on building community trust, supporting organizations that prevent violence, prioritizing targeted enforcement, and tracking results.
