Sergio Niz-Mendez, a 27-year-old citizen of Guatemala, pled guilty on March 23 in federal court in Sioux City to charges of illegal reentry into the United States and failure to register as a sex offender.
The case highlights efforts by federal authorities to address illegal immigration and enforce laws requiring registration of sex offenders. Niz-Mendez had previously been removed from the United States in 2018 and did not have permission to return. He was required to register as a sex offender due to a conviction for rape of a child with force in Massachusetts in 2016 but failed to do so after his return.
According to information presented at the plea hearing, Niz-Mendez was found in O’Brien County, Iowa, following his arrest for operating while intoxicated and eluding law enforcement. He admitted both his lack of legal status in the country and his failure to comply with sex offender registration requirements.
Sentencing will be scheduled after completion of a presentence report before United States District Court Judge Leonard T. Strand. Niz-Mendez remains in custody pending sentencing. The maximum penalty for illegal reentry is two years’ imprisonment, a $250,000 fine, and one year of supervised release. For failing to register as a sex offender, he faces up to ten years’ imprisonment, a $250,000 fine, and five years up to life on supervised release.
This prosecution is part of Operation Take Back America—a nationwide initiative by the Department of Justice aimed at addressing illegal immigration issues and combating violent crime.
